Current Title Search

Current Title Search

Each state and territory in Australia has its own Land Titles Office that maintains a registry of land ownership for their jurisdiction. Legislation requires that the register be publicly searchable. Titles are maintained for all types of land - residential, rural and commercial, freehold or leasehold, including houses, units, townhouses, even air-space and underground lots.

A Current Title Search gives you a copy of the land registry title record for a property as at the time the search is performed. This search will show you:

  • the current registered owners names
  • the title identifiers such as a title reference and the lot and plan description
  • details of any encumbrances registered on the title (mortgage, caveat, easement etc)
  • the dealing or instrument numbers of the above entries and the dates registered

Some jurisdictions differ slightly in the way the data is presented, but in effect, they all give you the details you may need to discover the above.

Historical Title Search

Historical Title Search

Each state and territory in Australia has its own Land Titles Office that maintains a registry of land ownership for their jurisdiction. Legislation requires that the register be publicly searchable. Titles are maintained for all types of land - residential, rural and commercial, freehold or leasehold, including houses, units, townhouses, even air-space and underground lots.

An Historical Title Search gives you the historical record of all of the transactions going on and off the title back in time to when that particular title was created. This search will show you:

  • the current and previous registered owners names, or in NSW, the type of dealing, date and dealign number
  • the title identifiers such as a title reference and the lot and plan description
  • details of any encumbrances registered on or removed from the title (mortgage, caveat, easement etc)
  • the dealing or instrument numbers of the above entries and the dates registered

Some jurisdictions differ slightly in the way the data is presented, but in effect, they all give you the details you may need to enquire into the above. Some further searching or obtaining copies of documents from the dealing numbers may be required to get full details of past owners names, for example, after you have your historical search and the dealing numbers of prior transfers.

Registered Plans / Title Diagrams

Registered Plans and Title Diagrams

A plan or diagram is the offical titles office record of the boundaries of the land described in a title search.

They may be called different names in different jurisdictions, but the information provided is essentially the same.

A Registered Plan gives you a copy of the land registry 'map' of the lot. This search will show you:

  • the boundaries of the land or lot
  • the measurements of the boundaries
  • location of items affecting the lot, such as an easement
  • positions of neighbouring lots, survey marks and other relevant data

A plan will allow you to locate the lot on the title definitively so you can make sure you are looking at the correct parcel of land contained in a title.

Building permits, builders, plumbers and associated services will usually need a copy of your plan if you are considering any such work.

Note, local council or water services such as sewerage and drainage are not usually presented ini the titles office plans, and seperate local council/authority searches are required if you need that type of information.

The search returns a list of any titles that contain the name searched. Note that it may not include the address of the property or co-owners names - only the title reference or the lot and plan description. The titles office requires that you perform further searches to ascertain deeper information.

Historical or previous ownerships are not generally available, as legislation doesn't require that titles office maintain publicly searchable registers in that regard. Historical searching can only be done on a particular property, not a name.

Name searches are covered under federal and state privacy legislation and other principles and can only be undertaken for genuine business purposes, such as litigation or legal action, when required for a government agency, credit and finance needs, proof of ownership and the like. Marketing, using for unsolicited sales or contacting an owner of a lot as a result of a search is prohibited, as is disclosing the information to third parties, except where permitted by law and for the above genuine business use cases.

Some jurisdictions require a signed privacy acknowledgment or identification to be given prior to being able to undertake a search, and we'll email you one if your order requires it.

Copy Title Dealing

Copy Title Dealing or Instrument

Each transaction registered on a title deed is given a unique identifying number, called an instrument or dealing number.

With that number, which is obtained from a title search (either current or historical), you can get a copy of that particular number.

For example, with a dealing number for a transfer form lodged after a property has been sold, you can get a copy of that actual transfer document and see the full particulars - including party names, witnesses, signatures (or electronic signing details), dates, transfer amount (sale price) or reason (court order, gift etc). Likewise, you can get a copy of an easement, for example, to find out the written terms and conditions, such as access to or through a neighbouring lot or for drainage or services etc).

Note, most documents are imaged and available electronically, but some older ones may need retrieving from the state archives and imaging before they be supplied.

ASIC Current Company Extract

An ASIC Current Company Extract helps you verify the legitimacy of an entity by providing details about a company and is good for helping make low-risk decisions using verified data.

The ASIC Current Company Extract includes information about:

  • Current officeholders including company directors and secretaries
  • Current registered office addresses and current principal place of business
  • Current shareholders including details of shareholdings (excluding public companies)
  • Appointments of external auditors, liquidators and administrators
  • Document details on all forms lodged with ASIC

ASIC Historical Company Extract

An ASIC Historical Company Extract will include all the details in a Current Company Extract plus any prior details relevant to the type of organisation.

An Historical Company Extract helps you verify the legitimacy of an entity by providing details about a company and is good for helping make low-risk decisions with verified data.

Annual returns were abolished on 1 July 2003, however, previously lodged returns will still show on Historical Company Extracts.

Information in this extract generally includes:

  • Current and previous officeholders including company directors and secretaries
  • Current and previous registered office addresses and current and previous principal places of business
  • Current and previous shareholders including details of shareholdings (excluding public companies)
  • Appointments of external auditors, liquidators and administrators
  • Document details on all forms lodged with ASIC

An ASIC Personal Name Search allows you to find out details about people associated with organisations registered by ASIC.

An extract will contain the person's name, birth details, organisation name, ABN/ACN number and current status, role(s) held by the person and residential address as well as the date appointed and date ceased, and where applicable:

  • Banned futures representatives
  • Banned securities representative
  • Disqualified directors

If you are considering appointing a new company officer or need to know someone's corporate roles, this search is a must.

To check if an individual has been or is currently a Bankrupt in Australia, this search provides an extract from the Australian Financial Security Authority (AFSA) Bankruptcy Registry.

The AFSA Bankruptcy Search searches across the National Personal Insolvency Index (NPII). The NPII is maintained and updated by AFSA and contains over 500,000 records dating back to August 1928 that have been recorded against individuals by Australian State and Federal Courts.

PPSR Searches

PPSR Register Search - Individual Grantor

A PPSR Individual Grantor search provides you with a check for charges given over personal property (assets other than land). For an individual grantor, this can include things like stock in trade, leased assets, business assets and raw materials, work in progress or goods on consignment or held pending sale. Prior to the PPSR system, these were commonly called Bills of Sale.

PPSR searches should always be undertaken when purchasing or lending money against any valuable asset (other than land - where a mortgage is registered on the title deed).

PPSR Register Search - Organisation Grantor

A PPSR Organisation search provides you with a check for charges given over a company's personal property (assets other than land).

PPSR Register Search - Motor Vehicle

A PPSR Motor Vehicle search provides you with a basic check for financial interests, written off records and stolen vehicles.

Included in the report are written off records, finance owing, odometer check, stolen vehicle check, registration details and VIN validation.

You can search by registration, chassis or VIN number.

PPSR Register Search - Watercraft

A PPSR search provides you with a basic check for financial interests, written off records and stolen watercraft.

You can search by Hull ID or Official number issued by Registrar of Ships.

PPSR Register Search - Serial Number

A PPSR Serial Number search provides you with a check for charges given over personal property (assets other than land).
